NIYO BUSINESS GROUP (NBG EVENTS) - TERMS AND CONDITIONS**
1. AGREEMENT TO TERMS
By accessing and using the services of NIYO BUSINESS GROUP, operating as NBG Events ("we," "us," or "our"), you ("Client," "you," or "your") agree to be legally bound by these Terms and Conditions. This agreement applies to all services we provide, including event decor and design, equipment and furniture rentals, attire sales and rentals, floral design, and accessories. If you are booking on behalf of an organization, you confirm you have the authority to bind that entity to these terms. Continued use of our services constitutes ongoing acceptance of any updated versions of these terms posted on our website or communicated to you.
2. SERVICES AND BOOKING
All services begin with a consultation to understand your vision, followed by a formal proposal. A booking is only confirmed once we receive your signed contract and the non-refundable reservation deposit, which is 50% of the total estimated cost. The remaining balance is due in full no later than 14 days prior to your event date. All prices quoted are valid for 30 days and are subject to change until a deposit is received and a contract is executed.
We understand that plans may evolve. Changes to the scope of services must be submitted to us in writing at least 30 days prior to your event. We will accommodate reasonable requests but reserve the right to apply additional charges for modifications made within 30 days of the event date, based on labor and material availability. In the rare event that a specified material or product becomes unavailable, we reserve the right to substitute it with an item of comparable or superior quality and aesthetic value.
3. PAYMENT TERMS
Our payment schedule is designed to secure our mutual commitment and cover initial costs. The 50% reservation deposit is due upon signing the contract. The final 50% payment is due 14 days before the event start date. Payments can be made via bank transfer, credit/debit card, or approved mobile money platforms. A late payment fee of 5% per month will be applied to any balance not received by the due date.
Should you need to cancel your event, the following policy applies: Cancellations made 90 days or more before the event will result in the forfeiture of the deposit only. Cancellations made 60 to 89 days prior will incur a charge of 50% of the total contract value. Cancellations made 30 to 59 days prior will incur a charge of 75% of the total contract value. Cancellations made within 29 days of the event will be charged 100% of the total contract value. Requests to change your event date are subject to our availability and may incur a rebooking fee.
4. RENTAL TERMS
The standard rental period for all equipment and furniture is 24 hours, typically covering delivery, the event day, and pickup the following day, unless a specific schedule is agreed upon in your contract. Overtime use will be charged at 25% of the daily rental rate for each additional 24-hour period. You are responsible for the rented items from the time they are delivered to the venue until they are collected by our team.
A security deposit may be required for high-value rental items and is fully refundable within 7 business days after the items are returned and inspected, provided there is no damage or loss. The client accepts full financial responsibility for any loss, theft, or damage to rental items beyond normal wear and tear. Charges for damaged or missing items will be based on the current replacement cost plus a 20% administrative and processing fee. Rental items must be used only for their intended purpose and may not be altered, sublet, or removed from the contracted venue without our prior written consent.
5. ATTIRE AND ACCESSORIES
For attire rentals, the standard rental period is three days: pickup is available one day before the event, and items must be returned by the end of the business day following the event. A late return fee of 50% of the daily rental rate will be applied for each day the items are overdue. All rented attire must be returned in its original condition, free of stains, tears, or damage. We offer a professional cleaning service for an additional fee; if you choose to clean items yourself, you must provide a receipt from a certified professional cleaner upon return. Damage charges will be assessed up to the full replacement value of the garment.
For purchased attire, all sales are final unless the item is found to be defective. Any defects must be reported within 24 hours of receipt. Custom-made and altered items cannot be returned or exchanged. We include a specified number of fittings in our service; additional alterations requested by the client will be charged separately. Final fittings must be completed at least 7 days before the event to ensure timely completion.
6. DECOR AND FLORAL SERVICES
Our decor and floral services include setup prior to your event and removal after its conclusion, at times specified in your contract. It is your responsibility to ensure we have access to the venue at these agreed times. Any delays caused by lack of access or venue restrictions may result in additional labor charges. We will work within the rules of your venue but are not liable if the venue's policies prevent the full execution of our planned design.
We use fresh, seasonal flowers, and their availability can fluctuate. We reserve the right to make substitutions with blooms of similar style, color, and value if necessary. As natural products, flowers may have variations in color, size, and bloom stage, which we consider part of their beauty. Floral arrangements are designed as temporary installations for your event day and are not intended to be permanent keepsakes.
7. LIABILITY AND INSURANCE
Our total liability to you for any claim arising from our services is limited to the total amount you have paid under your contract. We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government restrictions, strikes, or severe weather conditions ("Force Majeure").
You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of our services or your negligence. We carry general liability insurance for our operations. For events with high-value rentals or complex installations, we may request proof of your event insurance. You are responsible for ensuring the venue is safe for our staff and equipment and that all necessary permits for our work have been obtained.
8. INTELLECTUAL PROPERTY
All designs, concepts, proposals, sketches, and mood boards created by NBG Events remain our exclusive intellectual property. You are granted a license to use these designs for your specific event only. You may not replicate, photograph for reproduction, or permit others to copy our designs without our express written permission. We retain the right to photograph our work at your event and to use these images for our portfolio, website, and marketing materials. If you prefer we do not use images from your event, you must make this request in writing prior to the event date.
9. HEALTH AND SAFETY
The safety of our team, your guests, and your property is paramount. We comply with all applicable health and safety regulations. Our staff reserves the right to withdraw from any situation they deem unsafe without penalty. You must inform us of any known hazards at the venue prior to our setup. In light of public health concerns, our services will be delivered in compliance with prevailing local health guidelines, and our policies may be adjusted accordingly to ensure safety.
10. DATA PROTECTION
We collect and process your personal data in accordance with our Privacy Policy to provide our services, manage your account, and, with your consent, send you marketing communications. We implement appropriate security measures to protect your data but cannot guarantee absolute security for data transmitted over the internet. You may opt out of marketing communications at any time.
11. DISPUTE RESOLUTION
These Terms and Conditions are governed by the laws of [Your Country/State]. In the event of a dispute, we strongly encourage open communication to reach an amicable resolution. If a dispute cannot be resolved through good-faith negotiation within 30 days, both parties agree to submit to mediation with a neutral third party before pursuing any legal action. The costs of mediation shall be shared equally.
2. GENERAL PROVISIONS
This document, together with your signed contract, constitutes the entire agreement between us regarding the services. Any prior discussions or agreements are superseded. If any part of these terms is found to be unenforceable, the remaining provisions will continue in full effect. We may update these terms periodically, and the latest version will always be posted on our website. Your continued use of our services after such changes constitutes your acceptance of the new terms.
Return and Refund Policy
Services and Custom Orders:** All payments for design services, consultation fees, and custom-made items (including bespoke decor elements, tailored attire, and personalized floral designs) are final and non-refundable. Once creative work has commenced or custom materials have been ordered specifically for your event, refunds cannot be issued, as these resources cannot be repurposed. We commit our time, expertise, and materials exclusively to your event upon booking.
Rental Equipment and Attire:** Refunds are not provided for rental services after delivery has been made. If you need to cancel a rental order, you may be eligible for a partial credit toward a future event if the cancellation is made more than 30 days prior to your scheduled date, subject to a 25% administrative fee. No credits or refunds are issued for cancellations within 30 days of the event. Security deposits for rentals are fully refundable within 7 business days after all items are returned, inspected, and found to be in acceptable condition, free of damage, loss, or excessive soiling.
Standard Retail Purchases: Unused, non-custom attire and accessories purchased from our boutique may be returned within 7 days of receipt for a full refund, provided the items are in original, saleable condition with all tags attached and in their original packaging. Return shipping costs are the responsibility of the customer. After 7 days, all sales are final. Sale items, undergarments, and altered merchandise cannot be returned.
Problems & Exceptions: Your satisfaction is our priority. If there is a defect in a purchased item, an error in our fulfillment, or significant damage to rental items upon delivery, you must notify us within 24 hours of receipt or delivery by emailing support@nbgevents.com with photos. We will promptly arrange for a replacement, repair, or issue a refund or credit for the affected item. This policy does not cover changes of mind, weather-related issues, or venue restrictions that prevent the use of our services.
Refund Processing: Approved refunds will be issued to the original payment method within 14 business days of our receiving the returned items or approving the refund request. Please note that bank processing times may cause additional delays before the funds appear in your account.
